Deed of Family Arrangements

Sometimes families or beneficiaries decide they would like to distribute the estate in a way that is different to that required by the Will or the Administration Act. It is possible to do this as long as the executor or administrator and all the beneficiaries agree.

It is best to record this agreement in a formal document which is sometimes called a Deed of Family Arrangement. Before signing a Deed of Family Arrangement, you may need to obtain your own independent legal advice so you are fully aware of the terms you are agreeing to.
